As the debate over the proliferation of intoxicating hemp products across Illinois builds, it is imperitive that legislators and members of the public understand what these products are, where they come from, and how they should be regulated.
This site attempts to cut through the confusion and rhetoric published by the intoxicating hemp industry, and provide a basic understanding about these cannabis products available on corners throughout Illinois.
Same Substance, Different Name
FIrst and foremost, hemp is the same plant as cannabis, (marijuana, pot, etc.). The only distinction between hemp and cannabis is that hemp is supposed to have a tiny amount (.3% by dry weight) of intoxicating substances. This is measured when the plant is harvested.
In 2018, the federal government legalized the production and sale of hemp as a way of encourgaing the development of an industrial hemp industry producing textiles, petroleum substitutes, and the like. According to its authors, the Farm Bill was NOT intended to legalize intoxicating hemp products.
Chemists have discoverd ways to synthesize otherwise legal hemp into highly intoxicating products. These products take the form of edibles (such as gummies and choclates), drinks, vapes, and even smokeable flower and joints. All of these synthetic intoxicating products are now available at gas stations, tobacco shops and liquor and convenience stores.
Unlike legal cannabis in Illinois, intoxicating hemp products, despite being the same, are not regulated under Illinois cannabis laws. Intoxicating hemp products have no restrictions on manufacturing, contents, potentcy, advertising, transportation, distribution or possession.
The vast majority of intoxicating hemp products are grown and produced outside of Illinois. It is beleived that most of these products come from Colorado, Oklahoma, and even China. The production of these products is well outside the protections of Illinois law. Hundreds of millions of dollars leave Illinois and go to the producers of these products, bypassing Illinois farmers and other Illinois businesses.
According to the Illinois Hemp Business Association, intoxicating hemp products are an $800,000,000 business in Illinois. While legal cannabis in Illinois is heavily taxed by both the State and local governments, thus contributing millions back to Illinois communities, intoxicating hemp products provide no such benefit.
Legal cannabis in Illinois is highly regulated from the seed to the sale. Every step of the growing, manufacturing, testing, transportation and sale process is tightly controlled by statute to ensure that Illinois has safe products, keeps cannabis in the legal marketplace, and provides a stable and productive industry.
